Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and RDI Cordier, St-Prex, Vaud, Switzerland (“Nanotam”, “we”, “us”, “our”) governing your access to and use of the Nanotam websites, applications, APIs, data displays and related services (collectively, the “Service”).
By accessing or using the Service, creating an account, clicking accept, or otherwise indicating agreement, you accept these Terms and our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.
1. Critical aviation & safety disclaimer (read carefully)
Nanotam is a non-certified situational-awareness and information aid only.
- It is not an official source of aeronautical information (AIS/AIM).
- It is not certified, approved, qualified or endorsed by any aviation authority as a primary briefing, navigation, ATC, weather or operational decision tool.
- It is not a substitute for official NOTAMs, AIP/AIC, ATIS, ATC clearances, company SOPs/OM, dispatch releases, approved weather sources, charts, or any other required documentation.
- AI interpretations, visualisations, detections, crowd reports, runway-in-use inferences, weather/wind layers and similar features may be incomplete, outdated, incorrect, delayed, mis-prioritised or misleading.
You alone are responsible for the preparation, conduct and safety of every flight and ground operation, and for compliance with all applicable laws, regulations, licences, airspace rules, ATC instructions, operator policies and SOPs. Any decision you make — including to depart, continue, divert, delay, change routing, select a runway, or rely on or ignore any information shown in the Service — is made entirely at your own risk.
You expressly agree that you will not treat the Service as authoritative, and that you will independently verify all operationally relevant information against official and company-mandated sources before and during every flight. Failure to do so is your responsibility, not ours.
2. Assumption of risk & no reliance
To the maximum extent permitted by law, you acknowledge and agree that:
- you use the Service voluntarily and with full understanding of the limitations above;
- you do not rely on the Service as the sole or primary basis for any flight-critical or safety-related decision;
- you will not claim that Nanotam “misled” you, “instructed” you, or “caused” any operational decision — the Service provides optional information only; judgement and final decisions remain yours (or your operator’s);
- crowd-sourced reports, automatic detections and AI outputs are inherently uncertain and may conflict with reality or official information;
- connectivity, coverage, latency and third-party data feeds may fail without notice.
3. Eligibility & accounts
You must be legally capable of entering into these Terms. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” includes that organisation.
You are responsible for account credentials, device security and all activity under your account. Notify us promptly of unauthorised use. We may refuse, suspend or reclaim accounts at our discretion.
4. Free access, plans & changes to monetisation
The Service (or parts of it) may currently be offered free of charge. We may at any time, with or without prior notice (except where mandatory law requires notice):
- introduce fees, subscriptions, freemium limits, usage caps or paid tiers;
- change pricing, features included in free or paid plans, or geographic availability;
- add advertising, partner offers or sponsored content;
- discontinue, modify or replace any feature.
Continued use after a monetisation or plan change constitutes acceptance of the new commercial terms presented to you. If you do not agree, you must stop using the Service. Fees already paid are non-refundable except where mandatory law requires otherwise.
5. Licence to use the Service
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for your lawful personal or internal professional aviation purposes. We may revoke or limit this licence at any time.
You must not (except to the extent mandatory law prohibits these restrictions):
- copy, modify, reverse engineer, decompile or create derivative works of the Service;
- scrape, bulk-download, harvest or systematically extract data from the Service;
- resell, sublicense, republish or commercially exploit the Service or its data outputs without our prior written consent;
- bypass technical or usage limits, or probe for vulnerabilities except in a coordinated disclosure we authorise;
- use the Service for unlawful, unsafe or deceptive purposes.
6. Acceptable use & community reports
You agree not to:
- submit false, reckless, malicious or knowingly inaccurate reports or content;
- impersonate others, misrepresent qualifications, or interfere with other users;
- upload malware or content that infringes third-party rights;
- use the Service in a way that could compromise aviation safety or violate ATC / regulatory obligations.
We may remove content, restrict features or suspend users at our sole discretion, without liability.
7. User content licence
You retain ownership of content you submit (including reports and feedback). You grant Nanotam a worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free licence to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display and otherwise exploit such content and derivatives in connection with operating, improving, promoting and commercialising the Service and related data products — including aggregated and anonymised insights — consistent with our Privacy Policy.
You represent that you have all rights needed to grant this licence and that your content is accurate to the best of your knowledge. You are solely responsible for content you submit.
8. Intellectual property
The Service — including software, models, UI, databases, compilations, trademarks and branding — is owned by RDI Cordier / Nanotam or its licensors. No rights are granted except the limited licence in Section 5. “Nanotam” and related marks are our trademarks. Feedback you provide may be used freely by us without obligation to you.
9. Third-party data, links & integrations
The Service may display or rely on third-party data (weather, aeronautical information, maps, traffic, etc.) and may link to or integrate with third-party services (including EFBs). We do not control and do not warrant third-party data or services. Your use of third-party services is governed by their terms. Official sources always prevail.
10. AI & automated features
Features such as AI NOTAM interpretation, relevance ranking, automatic event or runway detection, and similar automated outputs are probabilistic tools. They may omit critical items, invent or distort meaning, lag reality, or conflict with official publications. You must treat them as unverified assistance only and verify against authoritative sources.
11. Privacy & cookies
Personal data and cookies are processed as described in our Privacy Policy and Cookie Policy. Those documents form part of your agreement with us regarding data practices.
12. Disclaimer of warranties
To the maximum extent permitted by applicable law, the Service is provided “AS IS” and “AS AVAILABLE”, without any warranty of any kind, whether express, implied or statutory, including warranties of accuracy, completeness, timeliness, merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free / virus-free operation.
Without limiting the foregoing, we do not warrant that any NOTAM interpretation, map, report, detection, weather, wind, runway or other information is correct, current or suitable for operational use.
13. Limitation of liability
To the maximum extent permitted by applicable law, RDI Cordier, its officers, employees, contractors, partners and licensors shall not be liable for any:
- indirect, incidental, special, consequential, exemplary or punitive damages;
- loss of profits, revenue, data, goodwill, or business opportunity;
- cost of substitute services;
- personal injury, death, property damage, delay, diversion, go-around, cancellation, fuel burn, or any aviation / operational incident or claim;
- damages arising from reliance on (or inability to use) the Service, AI outputs, user reports, third-party data, or from any decision made by you or others in connection with the Service;
whether based on contract, tort (including negligence), strict liability or otherwise, even if advised of the possibility.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amounts you paid to us for the Service in the three (3) months before the claim, or (b) CHF 50 if you have paid nothing.
Nothing in these Terms excludes or limits liability that cannot be excluded under mandatory applicable law (for example, liability for wilful misconduct or gross negligence where such limitation is prohibited). Where mandatory consumer rights apply, they remain unaffected.
14. Indemnification
You agree to defend, indemnify and hold harmless RDI Cordier and its officers, employees, contractors and partners from and against any claims, damages, losses, costs and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your flights or operational decisions; (c) your content or reports; (d) your breach of these Terms or of law; or (e) any claim that you were misled by or relied on the Service.
15. Suspension & termination
We may suspend, limit or terminate your access to all or part of the Service at any time, with or without cause or notice, including for maintenance, risk, abuse, legal reasons, or discontinuation of the Service. You may stop using the Service at any time. Provisions that by nature should survive (including Sections 1–2, 7–8 and 12–20) will survive termination.
16. Changes to the Service and to these Terms
We may change, add or remove features, data sources, coverage or availability at any time without liability. We may update these Terms periodically. We will revise the “Last updated” date and may provide additional notice (for example in-app or by email) where appropriate. Continued use after changes become effective constitutes acceptance. If you do not agree, you must stop using the Service.
17. Export, sanctions & compliance
You must comply with applicable export control, sanctions and aviation regulations. You may not use the Service if you are prohibited from doing so under Swiss, EU, UK, US or other applicable law.
18. Governing law & venue
These Terms are governed by the substantive laws of Switzerland, excluding conflict-of-law rules. Exclusive jurisdiction lies with the courts of the Canton of Vaud, Switzerland, subject only to mandatory protections that may apply to consumers in their country of residence.
19. General
- Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement regarding the Service and supersede prior understandings on that subject.
- Severability. If any provision is held unenforceable, it will be modified to the minimum extent necessary, and the remainder will continue in force.
- No waiver. Failure to enforce a provision is not a waiver of future enforcement.
- Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or successor in connection with a reorganisation, merger or sale of assets.
- No third-party beneficiaries. Except for indemnified parties in Section 14, these Terms create no third-party beneficiary rights.
- Language. If these Terms are translated, the English version prevails to the extent permitted by law.
